NONE OF THE SERVICES PROVIDED TO YOU BY THE PROVIDER CAN BE CONSIDERED INVESTMENT SERVICES IN ACCORDANCE WITH APPLICABLE LAWS. THE PROVIDER DOES NOT GIVE OR PROVIDE TO YOU ANY GUIDANCE, INSTRUCTIONS, OR INFORMATION ABOUT HOW OR IN WHICH MANNER YOU SHOULD PERFORM TRANSACTIONS WHEN USING THE SERVICES OR OTHERWISE, OR ANY OTHER SIMILAR INFORMATION ABOUT THE INVESTMENT TOOLS TRADED, NOR DOES THE PROVIDER ACCEPT ANY SUCH GUIDANCE, INSTRUCTIONS, OR INFORMATION FROM YOU. NONE OF THE SERVICES CONSTITUTE INVESTMENT ADVICE OR RECOMMENDATIONS. NO EMPLOYEES, STAFF, OR REPRESENTATIVES OF THE PROVIDER ARE AUTHORIZED TO PROVIDE INVESTMENT ADVICE OR RECOMMENDATIONS. SHOULD ANY INFORMATION OR STATEMENT OF ANY EMPLOYEE, STAFF, OR REPRESENTATIVES OF THE PROVIDER BE INTERPRETED AS INVESTMENT ADVICE OR RECOMMENDATIONS, THE PROVIDER EXPLICITLY DISCLAIMS THAT THE SAME IS INVESTMENT ADVICE OR RECOMMENDATIONS AND SHALL NOT BE RESPONSIBLE FOR THEM.

We may grant access to third parties to our website in order to troubleshoot and/or maintain website, database or infrastructure related issues. These access are monitored and removed after scope of work is performed.

ALL PAYMENTS ARE FINAL AND FOR EVALUATION PURPOSES ONLY.

The registration fees are paid to allow you to access the OnlyFunds FX platform, models and services. The Customer is not entitled to a refund of the registration fees as the service is directly delivered after purchase. No refund applies to the service that OnlyFunds FX offers.

(1) Online Registration Terms

You are at least the age of majority in your state or province of residence and in no event less than 18 years of age.
You have provided Us with accurate, true and complete information about yourself.
You may not use our services for any illegal or unauthorized purpose.
A breach or violation of any of the Terms will result in an immediate termination of your Services.
You agree to maintain the confidentiality of any password and username and notify Us of unauthorized use.

(2) Know-Your-Customer (KYC)

Upon request by the Company, you may be required to complete our onboarding process, which includes due diligence and client verification procedures. This process involves collecting identification documents, including non-public personal information for you (if applicable).

You acknowledge that the Company shall accept you as a User only after you satisfactorily clear all the verifications required by us, including any required under the anti-money laundering and combatting financing of terrorism (“AML/CFT”) laws, conducted by the Company’s third-party AML/KYC service providers in accordance with the guidelines provided under the applicable laws.

In addition to the initial verifications undertaken by Us, you may be subject to periodic due diligence and verification to ensure ongoing compliance. You agree and confirm that you shall immediately inform Us if there are any changes in the information or documentation provided by you.

The Company may, at any time, refuse, restrict or limit the service or terminate this Agreement and close an Account, if the User is found to have provided incorrect, incomplete, inaccurate, or false information.

A breach or violation of any of the Terms, or any applicable law, will result in an immediate termination of your Services.

You agree and acknowledge that you are solely and wholly responsible for obtaining and maintaining any hardware, facilities, connections, licenses, permits, database, equipment, external software or any other resources as may be required and/or necessary for your use of the Services. The Company will not be liable for any costs, expenses, losses or damages incurred in this regard.

(3) General Conditions

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve transmissions over various networks; and changes to conform and adapt to technical requirements. Credit card information is always encrypted during transfer.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without express written permission by us.

(4) Accuracy and Timeliness of Information

We make every effort to ensure that the information we provide is accurate, however the information is also supplied by third parties and we are not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate sources.

This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

(5) Modifications and Pricing

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (accounts provided) without notice. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

(6) Products or Services

One registration per person is permitted. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at our sole discretion. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

(7) Accuracy of Billing and Account Information

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or unauthorized distributors.

You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

(8) OnlyFunds FX Evaluation and Live Stage

We provide evaluation challenges that allow users to demonstrate their trading ability before being considered for a funded account. Each evaluation challenge has specific rules and objectives. Failure to follow the rules results in termination of the account without refund.

Quickie Challenge – Maximum Loss Limit: 10% of initial account size. Maximum Daily Loss Limit: 5% of daily starting equity/balance. Profit Target: 10%. Minimum of 5 trading days required.
2 Round Challenge – Phase 1: 8% profit target, 3 minimum trading days. Phase 2: 5% profit target, 3 minimum trading days.
Algorithmic Affair – Phase 1: 10% profit target, 3 minimum trading days. Phase 2: 5% profit target, 3 minimum trading days.

Failure to meet the rules or targets will result in immediate termination without refund. The Company may, at its discretion, adjust account parameters or disqualify accounts in violation of these rules.

(9) Rules of Demo/Simulation Trading

Accounts inactive for 30 days or more will be terminated without refund.
Profits from trades held less than one minute will not be counted.
Trading is restricted around high-impact news events as defined in the platform’s calendar.
Lot size consistency must be maintained; significant deviations may result in account termination.
Single Day Rule: profit capped per day – 40% for $5,000–$50,000 accounts, 30% for $100,000–$1,000,000 accounts.
Prohibited practices include: gap trading, arbitrage, latency exploitation, HFT (high-frequency trading), toxic trading, martingale, copy trading, trade mirroring, using external EAs, gambling, overleveraging, overtrading, and poor money management.

The Company reserves the right to conduct compliance reviews, risk interviews, and withhold remuneration until all verifications are complete. Violations may result in account termination without refund.

(10) Optional Tools

We may provide you with access to third-party tools which we neither monitor nor control. You acknowledge and agree that we provide access to such tools “as is” without warranties, representations or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

(11) Third-Party Links and Providers

Certain content, products and services available via our Service may include materials from third parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

We may also block your account or withhold payments in case of suspicion of fraudulent activity, compliance violations, or association with restricted jurisdictions. You agree that OnlyFunds FX is not liable for losses incurred by reliance on third-party services.

(12) Risk Management and Compliance

All traders must maintain responsible risk management at all times. The Company monitors accounts to ensure compliance with drawdown limits, risk exposure, and trading style consistency. Practices such as opening excessive lots, breaching drawdowns, or placing reckless trades will lead to termination without refund.

The Company reserves the right to request risk management interviews with traders. Failure to comply with such interviews may result in suspension or termination. Repeated offenses or gross negligence may result in permanent bans from all services.

(13) Personal Information

Your submission of personal information through the store is governed by our Privacy Policy. By using our services, you agree to the collection, storage, and use of your information as outlined in our Privacy Policy.

(14) Prohibited Uses

In addition to other prohibitions set forth in the Terms of Service, you are prohibited from using the site or its content for:

Any unlawful purpose or to solicit others to perform or participate in any unlawful acts.
To violate any international, federal, provincial or state regulations, rules, laws, or local ordinances.
To infringe upon or violate our intellectual property rights or the intellectual property rights of others.
To harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability.
To submit false or misleading information.
To upload or transmit viruses or any other type of malicious code that may affect the functionality of the Service or of any related website.
To spam, phish, pharm, pretext, spider, crawl, or scrape.
For any obscene or immoral purpose.
To interfere with or circumvent the security features of the Service or any related website.
Multiple registrations with different emails for the purpose of exploiting the system.
Using the Services while simultaneously trading with another proprietary firm.

We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.

(15) Disclaimer of Warranties; Limitation of Liability

We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.

You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.

You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.

In no case shall OnlyFunds FX, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

(16) Indemnification

You agree to indemnify, defend and hold harmless OnlyFunds FX and our affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

(17) Severability

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service. Such determination shall not affect the validity and enforceability of any other remaining provisions.

(18) Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service are effective unless and until terminated by either you or us. You may terminate these Terms of Service at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination.

(19) Disputes

In the event of disputes over payments, chargebacks, or other financial claims, OnlyFunds FX reserves the right to suspend or terminate accounts immediately. Any account involved in a payment dispute will be banned and will not be eligible for further services. Active accounts linked to disputed transactions will also be closed.

(20) Entire Agreement

These Terms of Service and any policies or operating rules posted by us on this site constitute the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. OnlyFunds FX is committed to promoting responsible trading practices among all participants. This Responsible Trading Policy forms an integral part of the Terms and Conditions and outlines the expectations and obligations of traders using our services.

1. Purpose

The purpose of this policy is to ensure that all trading activities carried out under OnlyFunds FX accounts are conducted in a responsible, disciplined, and professional manner, minimizing excessive risk and preventing abusive or manipulative practices.

2. Key Principles of Responsible Trading

Risk Management: Traders must employ sound risk management practices, including limiting position sizes, adhering to drawdown limits, and avoiding overexposure.
Consistency: Trading strategies should be consistent and sustainable. Sudden, erratic, or reckless trading practices are discouraged.
Professional Conduct: Traders must treat demo and funded accounts with the same discipline as real capital, avoiding gambling or high-risk behavior.
Transparency: Traders must maintain honesty and integrity, avoiding any attempt to manipulate results or exploit system vulnerabilities.

3. Examples of Irresponsible Trading

Opening disproportionately large positions relative to account size.
Engaging in overleveraging or overtrading.
Using prohibited strategies such as latency arbitrage, HFT, toxic trading, or trade mirroring.
Trading recklessly around major news events to exploit volatility.
Maintaining open positions for less than one minute with the intention of exploiting execution delays.

4. Monitoring and Enforcement

OnlyFunds FX continuously monitors accounts to ensure compliance with this Responsible Trading Policy. Any account found in violation may be subject to corrective actions, including but not limited to:

Temporary suspension of the account.
Immediate termination without refund.
Disqualification from progressing to funded stages.
Denial of performance fees or payouts.

5. Trader Obligations

Understand and adhere to all trading rules, including maximum loss limits and daily drawdowns.
Trade with discipline and avoid gambling behavior.
Cooperate fully with any compliance reviews, risk interviews, or requests for additional information.
Immediately report any system errors, bugs, or unfair advantages encountered.

6. Consequences of Non-Compliance

Failure to comply with the Responsible Trading Policy may result in suspension, termination of services, or permanent bans. OnlyFunds FX reserves the right to take any necessary action to protect the integrity of its services.

7. Acknowledgment

By registering with OnlyFunds FX and participating in our evaluations or funded programs, you acknowledge that you have read, understood, and agreed to comply with this Responsible Trading Policy. Continued use of our services constitutes acceptance of these terms.
